1. About VigilGarden

VigilGarden is a service that lets people create and visit small online memorials for someone who has died. Creating a memorial and lighting a candle are free. Some optional tributes are paid; see the Refund Policy.

2. Who can use it

You must be at least 13 years old to use VigilGarden. If you are in the European Union or another region with a higher minimum digital age, you must meet that age. By using the site you confirm that you meet these requirements.

3. Your account and your memorials

You can create a memorial without an account. If you sign in, you can claim and edit memorials that you created or that you are authorized to manage. You are responsible for keeping your sign-in details safe and for any activity on your account.

Memorials you create may be reviewed by us before they become publicly visible. We may refuse, hide, or remove a memorial that we believe violates these terms or our Content Policy.

4. Content you submit

You keep ownership of the names, photos, words, and other content you submit. By submitting it, you give VigilGarden a non-exclusive, worldwide, royalty-free license to host, display, and reasonably format that content for the purpose of operating the service.

You confirm that you have the right to submit anything you upload. Do not upload content that you do not own or have permission to use.

5. Acceptable use

Memorials must honor a real person who has died. Do not use VigilGarden for harassment, impersonation, hate speech, sexual content, scams, advertising, political campaigning, medical or legal advice, or any other purpose that conflicts with our Content Policy.

6. Paid features

Some features (for example, an annual candle, or a paid tribute on a memorial) require payment. Payments are processed by Stripe. By purchasing, you agree to Stripe’s terms in addition to ours. Pricing shown at checkout is the price you will be charged. Refunds are described in our Refund Policy.

VigilGarden does not collect or pass on charitable donations and makes no claim that any payment supports a charity unless that claim is explicitly written into the product at checkout.

7. Service availability and changes

We may change, suspend, or stop offering parts of VigilGarden at any time. We will try to give reasonable notice for material changes. We do not guarantee uninterrupted access.

8. Termination

You can stop using VigilGarden at any time. We may suspend or terminate your access if we believe you have violated these terms or our Content Policy, or if we are required to by law.

9. Disclaimer and limits

VigilGarden is provided “as is.” To the extent allowed by law, we disclaim warranties about availability, accuracy, and fitness for a particular purpose. Our total liability for any claim related to the service is limited to the amount you paid us in the twelve months before the claim, or one hundred US dollars, whichever is greater.

10. Changes to these terms

We may update these terms. If we do, we will update the date at the top of this page. Continued use of the service after a change means you accept the updated terms.
