Respect for copyright
VigilGarden respects copyright. Photos and writing that appear on memorials are submitted by visitors. If you believe content on VigilGarden infringes your copyright, you can ask us to remove it using the procedure below.
Submitting a takedown notice (DMCA)
To submit a notice under the U.S. Digital Millennium Copyright Act, send an email to support@vigilgarden.com with the subject line “DMCA Notice” and include the following:
- Your physical or electronic signature (a typed name is acceptable in an email).
- A clear description of the copyrighted work you claim has been infringed.
- The URL on VigilGarden of the content you want removed.
- Your full name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Knowingly false notices may result in liability under U.S. law.
Counter-notice
If material you posted has been removed in response to a DMCA notice and you believe the removal was a mistake, you can submit a counter-notice to the same address. A counter-notice must include:
- Your signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your full name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or, if your address is outside the United States, a court in which the service provider may be found, and that you will accept service of process from the person who provided the original notice.
Repeat infringers
We may, in our sole discretion, terminate the accounts of users who repeatedly upload material that infringes copyright.
Designated agent
The designated agent for receiving notifications of claimed infringement under the DMCA will be listed on this page once registered with the U.S. Copyright Office. Until then, please send notices to support@vigilgarden.com.
